KYA AHL E HADEES, AHL E QAYAAS HAIN?

Ye ek sawaal hai k kya hum ahle qayaas hai?
Muqallideen Hazraat ka aetraaz hai k hum ahle hadees nahi hum ahle qayaas hai kyunki hum kai masle mai ijtihaad karte hai isi liye hum ahle qayaas hai kya ye kehna sahi hai?
Zara dekhte hai
Mai Muqallideen Hazraat ko bata dena chahta hu k hum qayaas, ijtihaad aur ijma k munkir nahi hai
Hum jis masle mai ijtihaad karte hai to hum sabse pehle ye dekhte hai k kya Quran O hadees mai iska koi zikr aya hai jis se k hum is masle mai ijtihaad kar sake

1. Kya hum namaz ki haalat mai mobile ko band kar sakte hai?
Is masle mai humne ijtihaad kiya jesa k hadees mai aya hai k Allah k Rasool Sallallahu Alaihi Wa Sallam ne bacche ko gooad mai utha kar namaz padhijab aap ruku mai jate to use zameen par bitha dete jab dobara qayaam karte to use utha lete (Bukhri Kitabus Salaat)
is hadees se ye sabit hua k hum namaz ki halat mai mobile ko switch off kar sakte hain kyunki mobile se namaz mai khalal paida hoti hai isi liye use band kar dena chahiye
Mai yaha Muqallideen Hazraat ko do tok baat kehna chahunga main apne bhaiyo se sawal karta hu k wo namaz ki halat mai mobile kyu band karte hai?
jab k Durre Mukhtar mai aya hai k agar namaz ki halat mai quran ko utha liya to namaz batil ho jati hai wahi dusri taraf Fatawa E Alamgiri mai kaha gaya hai k kutte ko utha kar namaz ho jayegi
Hadees ki tamaam kitabo mai mojood hai k kutte k jhute ko 7 baar dhulo to paak hoga yaha par dono batae hadees k khilaf hai

2. Kya bhains ko gosht halal hai?
Muqallideen Hazraat ne yaha par ek sher padha hai zara dekhte hai wo sher kya hai
"Ek bhains gair muqallid ko muqallid bana deti hai"
ab yaha par sawal ye paida hota hai k agar hum bhains ka gosht khaye to kya hum muqallid ban jayenge?
zara dekhte hai
Quran o Hadees mai aya hai k gaaye (cow) ka gosht halal hai humne yaha ijtihaad kiya kyunki Arab mai us waqt bhains nahi thi sirf Gaaye (cow) thi lekin Ajam mai bhains thi waha gaaye (cow) kam thi jesa k girgit ki jins (nasal) chipkali hai usi tarha gaaye (cow) ki jins bhains hai bas rang (color) ka fark hai aksar a'emma hazraat ne bhi yahi kaha hai aur wese bhi India mai gaaye (cow) par pabandi (ban) hai aur yaha bhains jayada hai isi liye hum uski nasal bhains ko halal kehte hai aur khate hai aur qurbani bhi dete hai

Ab hame ye dekhna hai k kya Kayaas aur ijtihaad hadees se sabit hai?
Ji han sabit hai zara dekhte hai Hadees is tarha hai

Allah k Rasool Sallallahu Alaihi Wa Sallam ne farmaya: agar hakim faisla karne mai ijtihaad karta hai phir uska faisal sahi ho jaye to use 2 ajr hai aur faise mai ijtihaad karta hai to phir galti karta hai to use 1 ajr hai (Bukhari Hadees No. 7352, Muslim Hadees No. 3240)

Is hadees ko aap samne rakhey aapke sare shubhaat door ho jayenge aru is hadees se ye bhi pata chala k agar hum kisi masle mai ijtihaad kare to hum Ahle Qayaas nahi ho jayenge hum Ahle Hadees hi rahenge
Imam Abu Hanifa Ra, Imam Malik Ra, Imam Shafai Ra, Imam Ahmed Ibne Hambal Ra ne kai maslo mai ijtihaad kiya unka jo ijtihaad sahi hua to unhe 2 ajr milenge aur agar galti hui to unhe 1 ajr milega
Imamo se galti bhi hui hai kyunki wo masoom Anil Khata nahi they lekin hamare muqallideen bhai hadees hone k bawajood us ijtihaad par amal karte hai jisme khata hui hai aur kehte hai hamare imam ne kara hai hum bhi karenge kya hamare imam galat they?
Mai aapko bata dena chahta hu k imam sahab ne tahqeeq ki qayaas kya aur khata bhi hui tab bhi unko 1 neki milegi kyunki unhone mehnat ki hai lekin aap unki khata par amal karenge to to aap ko neki nahi gunah milega
Imam Ahmed bin Hanbal Ra ne kaha tha mere nazdeek zaeef hadees jayada mehboob hai raaye k mutabiq imam sahab nahi chahte they k mai zaeef hadees hone k bawajood bhi apni koi raaye du imam sahab ne zaeef hadees par hi amal kar liya sahih aur Hasan ki adam maujoodgi mein...
iqdul jayyed mai kaha k jab tumhe sahi hadees mil jaye to us par amal kar lena aur meri baat ko chhod dena
Abhi qayamat tak ki zindagi mai kai aise masle hamare samne ayenge jinka hal quran o hadees mai sarahatan nahi hai un maslo mai hame ijtihaad karna padega masalan hum chand (moon) par hai to hame kaha rukh karke namaz padhni hai, jaha 6 mahine sooraj nahi nikalta waha namzo ka waqt kya ho etc.
Jesa k ye sabit hua k ijtihaad karna hadees se bhi sabit hai aur ye qauli sunnat bhi hai phir bhi hame Ahle Qayaas kehna ye kaha ki samajhdari hai


Is se ye sabit hua k agar hum kisi masle mai qayaas bhi kare to bhi hum Ahle Hadees hi hai.
